Question en français (traduction) : Notification des Pays-Bas relative à l’abaissement de la température maximale pour le transport des animaux
Le 25 février 2025, le gouvernement des Pays-Bas a notifié à la Commission une modification de ses lignes directrices relatives au transport des animaux à des températures élevées (notification n° 2025/0111/NL). Cette modification abaisse à 30 °C la température maximale à laquelle les animaux peuvent être transportés. Conformément à la procédure de notification prévue par la directive (UE) 2015/1535, la Commission peut bloquer cette règle pendant une période de 12 à 18 mois si une harmonisation au niveau de l’UE dans le domaine concerné est prévue ou déjà en cours. Tel est effectivement le cas, étant donné que le règlement sur le transport des animaux est actuellement en cours de révision (2023/0448/COD).
1. La Commission a-t-elle l’intention de bloquer la décision politique qui a été notifiée au motif que la révision du règlement sur le transport des animaux signifie qu’une harmonisation au niveau de l’UE dans le même domaine est déjà en cours ?
2. La Commission convient-elle que cette modification de la politique, si elle entrait en vigueur, entraînerait une distorsion significative du marché intérieur de l’UE ?
3. La Commission est-elle disposée à répondre aux observations formulées par diverses parties prenantes dans le cadre de la notification ?
Réponse en français (traduction) : 1. La question des températures élevées est actuellement examinée dans le cadre des négociations interinstitutionnelles en cours sur la proposition législative relative à la protection des animaux pendant le transport [1] . La Commission a adressé une lettre aux États membres pour les inviter à faire part de leurs préoccupations au Conseil plutôt que de se concentrer sur des mesures nationales, et leur demander de s’abstenir d’adopter des mesures nationales dans le domaine du transport des animaux.
2. La Commission convient que des règles nationales divergentes ne garantissent pas le bon fonctionnement du marché intérieur. L’adoption de règles nationales alors que les négociations interinstitutionnelles sur la proposition de nouvelle législation de la Commission en la matière sont en cours peut avoir une incidence négative sur l’égalité des conditions de concurrence entre les opérateurs. L’un des objectifs de la proposition législative est de garantir un cadre juridique plus clair qui évite la nécessité de règles nationales divergentes.
3. Conformément aux dispositions de la directive (UE) 2015/1535 [2], il appartient à la Commission et aux États membres de réagir aux projets de réglementations techniques notifiés par un État membre. La Commission prend note des contributions formulées par plusieurs parties prenantes concernant cette notification.
Question en anglais (original) : On 25 February 2025, the Government of the Netherlands notified the Commission of an amendment to its policy guideline on animal transport at high temperatures (notification number 2025/0111/NL). The policy amendment lowers the maximum temperature at which animals may be transported to 30 degrees Celsius. In accordance with the notification procedure under Directive (EU) 2015/1535, the Commission may block this policy rule for a period of 12 to 18 months if harmonisation at EU level in the area concerned is planned or already under way. As the Animal Transport Regulation is currently being revised (2023/0448/COD), that is indeed the case.
1. Does the Commission intend to block the policy rule that has been notified on the ground that revision of the Animal Transport Regulation means that EU harmonisation in the same area is already under way?
2. Does the Commission agree that as a result of this policy amendment, were it to come into force, there would be significant distortion of the EU internal market?
3. Is the Commission prepared to respond to the submissions made by various stakeholders in connection with the notification?
Réponse en anglais (original) : 1. The issue of high temperatures is being discussed in the ongoing inter-institutional negotiations on the legislative proposal on the protection of animals during transport [1]. The Commission sent a letter to the Member States urging them to stress their concerns at the Council rather than focusing on national measures, asking them to refrain from adopting national measures in the area of animal transport.
2. The Commission agrees that diverging national rules do not ensure a smooth functioning of the internal market. The adoption of national rules while inter-institutional negotiations on the Commission’s proposal for new legislation on this subject are ongoing can have potentially negative impact for the level playing field of operators. One of the objectives of the legislative proposal is to ensure a clearer legal framework and one that avoids the need for diverging national rules.
3. According to the provisions of Directive (EU) 2015/1535 [2] , it is at the discretion of the Commission and the Member States to issue a reaction on draft technical regulations notified by a Member State. The Commission takes note of the contributions made by several stakeholders regarding this notification.
