Preview: Question: Christine Herzog asks the Minister of Agriculture and Food Sovereignty about the various commercial forms of dog breeding and sales. She would like to know how many adult dogs can be bred before a breeder is no longer considered to be a  private enterprise authorized to sell puppies.

Answer: Article L. 214-6, III. of the French Rural and Maritime Fishing Code (CRPM) defines dog and cat breeding as follows: "Dog or cat breeding means the activity of keeping at least one breeding female from which at least one dog or cat is sold for financial gain", and paragraph IV of the same article defines dog sales as follows: "[...] a sale is understood to mean the surrender for financial gain of a companion animal without the breeding female that produced the animal being in one's keeping". In fact, anyone who owns a breeding female and sells at least one puppy is a breeder within the terms of the CRPM. Article L. 214-6-2 of the CRPM defines the various registration procedures for these breeders. These include - breeders who only produce dogs and cats registered in a pedigree book, and who sell no more than one litter of puppies or kittens per year and per tax household, are exempt from having to declare their business as required in the French Commercial Code (no need for a SIRET), need make no declaration to the Prefecture and need not demonstrate their knowledge. Breeders who sell no more than one litter of puppies or kittens per year and per tax household (not for registration in a pedigree book) need not declare their business to the Prefecture or demonstrate their knowledge,  but must register their business as stipulated in the French commercial code (SIRET required); - all other breeders not covered by the above two cases must be registered (mandatory SIRET and declaration to the Prefecture) and must provide proof of their knowledge. All must still provide and use facilities that comply with the health and animal protection regulations for these animals.
